According to Florida law, domestic violence means an assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any other criminal offense resulting in physical injury to any family or household member by another who is or was residing in the same single dwelling unit. Any Florida resident who has been victimized by domestic violence or who believes there is an imminent danger of domestic violence (the Petitioner) may apply for a domestic injunction against the person committing the domestic violence (the Respondent).
A domestic injunction, also known as an “order of protection” or a “restraining order”, is a court order that is ordered due to domestic violence. It informs the recipient of the order of all legal restrictions that the Court has ordered against him/her. It also creates legal sanctions if the order is violated. In order to obtain a domestic injunction, the domestic violence must have been between family or household members; the Petitioner must have been the victim of domestic violence or must be in fear of imminent violence; and the sworn petition must allege the existence of domestic violence with supporting facts.
