Median Income Test

A test to determine whether a person or married couple can file a Chapter 7 Bankruptcy.  The indiviual or couple can file a Chapter 7 if their household income falls below the “median income”, as reported by the United States Census Bureau, for their state of residence.  The median income is equal to the 50th percentile of household income.  For example, exactly one-half of Florida’s households have an income less than the reported “median income.” The median income figures are updated on February 1st and October 1st.

If an individual or couple  has gross income  above the median income,  they can still qualify to file Chapter 7 bankruptcy if they pass the means  test.
