In cases where there is a wide disparity of income between the parties, the court can award one party reasonable attorney fees.  This is not based upon “who wins” but on the parties’ relative need and ability to pay.  This is really just another form of support, and as such, the court can hold a party in civil contempt for failing to pay the court awarded attorney fees.
